SMS Terms of Service — Healthy & Active

These SMS Terms of Service ("SMS Terms") govern your participation in the Healthy & Active text message marketing program, operated by XR, LLC d/b/a Healthy & Active. By enrolling — through a checkout checkbox, online form, or keyword opt-in — you agree to these SMS Terms.
1. Program Description

- Message Types: Promotional offers, new arrivals, sale events, cart reminders, and order updates
- Message Frequency: Varies; you may receive multiple messages per month, more frequently during promotions

2. How to Enroll
You may enroll by checking the SMS opt-in box at checkout, submitting your mobile number through a form displaying the required disclosure, or texting our designated keyword to our sending number.
Disclosure — U.S. Subscribers
By providing your phone number and consenting to receive SMS marketing messages, you agree to receive recurring automated marketing text messages from Healthy & Active (XR, LLC) at the mobile number provided. Messages may include promotions, new arrivals, and order updates. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Disclosure — Canadian Subscribers (CASL)
By providing your phone number and consenting to receive SMS marketing messages, you expressly agree to receive recurring commercial text messages from Healthy & Active (XR, LLC), 15251 Pipeline Lane, Huntington Beach, CA 92649. Messages may include promotions and new product announcements. Your consent is not required for any purchase and may be withdrawn at any time by replying STOP. For help: info@healthyandactive.com. Enrollment in our SMS program is entirely optional and is not a condition of any purchase.
3. How to Stop Receiving Messages
You may unsubscribe at any time by:- Replying STOP to any message

After sending STOP, you will receive one confirmation message and be removed from our list. To re-enroll after unsubscribing, you must take an affirmative action to opt back in.
4. Compliance
Our SMS program operates in compliance with:
- The Telephone Consumer Protection Act (TCPA) and FCC regulations
- CTIA Messaging Principles and Best Practices
- 10DLC brand and campaign registration requirements (mandatory as of February 2025)
- Applicable state telemarketing and SMS laws, including quiet hours and frequency limits stricter than the federal standard (we apply the strictest standard as our nationwide baseline)
- Canadian Anti-Spam Legislation (CASL) and CRTC guidelines for Canadian subscribers
We do not send marketing messages to numbers on the U.S. National Do Not Call Registry or applicable state DNC registries without prior express consent.
5. Message Content and Sending Practices
All messages identify our brand and include an opt-out reminder. We do not send marketing messages before 8:00 a.m. or after 8:00 p.m. in the recipient's local time zone. We do not include explicit adult content or sexually graphic language in any SMS, consistent with CTIA S.H.A.F.T. carrier guidelines.
6. Canadian Subscribers — CASL
Our SMS program for Canadian subscribers relies exclusively on express consent. Implied consent does not apply to SMS marketing, and abandoned cart messages to Canadian subscribers require express consent before sending. Every SMS to a Canadian subscriber includes our brand name and access to our contact information at no cost to the recipient. Unsubscribe requests from Canadian subscribers are processed within 10 business days, as required by CASL. Consent applies only to messages from Healthy & Active / XR, LLC and is not transferable to any other brand or entity.
7. Privacy
Your mobile number and consent records are handled per our Privacy Policy. We do not sell your mobile number. Consent records are retained for a minimum of 5 years.
8. Age Requirement
Our SMS program is available only to individuals 18 years of age or older. By enrolling, you represent that you meet this requirement. Subscribers found to be under 18 will be removed immediately.
9. Carrier Support
Our program is supported by major U.S. and Canadian wireless carriers. Carrier participation may change without notice. We are not responsible for delivery failures caused by your carrier or network conditions.
10. Changes to These Terms
We may modify, suspend, or discontinue our SMS program at any time. Material changes will be posted at https://www.healthyandactive.com/pages/sms-terms with a revised Effective Date.
